Chase A+EP has created a personalized boutique service to guide dispute resolutions utilizing three process tools: mediation, arbitration and architect expert witness testimony. We believe that litigating any dispute is expensive in both human and financial terms and should be avoided by all parties if possible.
Currently on the American Arbitration Association’s Construction Arbitration Panel, the AAA Florida Foreclosure Mediation Panel and the Collins Center Residential Foreclosure Mediation Panel, we recommend an alternative dispute resolution approach through the established “rule-based” processes where mediation, arbitration and/or expert witness testing should be explored before litigation. Each process can be either independent of the others or interdependent, building from the informal to a binding outcome. The key to success is that the parties control their own eventual dispute solution, with the mediator and/or arbitrator assisting by managing the process in a fair and unbiased way. The expert, when needed, will highlight issues of fact to bring clarity to the discussion for both sides, in order to advance resolution.
Mediation – A neutral third party guides people in dispute through an informal, non-adversarial process toward a mutually agreeable resolution without prescribing what the solution should be.
Arbitration – A neutral third party or parties guide people in dispute through a formal, “rule- based” process to a non-binding or binding resolution and award.
Expert Witness Testimony – A party with specialized technical knowledge and experience regarding an issue or matter in dispute offers a professional opinion as to the context and factual standards that apply.
Fees – We currently maintain architectural license certifications in 19 states, offer architect expert witness services for Professional Liability, Florida 718 Condominium Statutes, Insurance E&O, and Construction Contract and Delay Claims in these states and conduct mediation and arbitration services throughout Florida. A onetime, non-refundable administrative fee per party is required at the initiation of the professional engagement. Following the primary conference, an hourly fee will be mutually agreed upon, including objectives and schedules.
